Notes for CORA LEE RIGGINS:

The Daily Democrat-News, Marshall, Friday, August 12, 1932

Mrs. J. W. Boatright Dead - Funeral Services Will be held Tomorrow at 1 o'clock at the Country Home.

Mrs. J. W. Boatright died yesterday at 6 p.m. at the home of her daughter, Mrs. A. J. Dingley, 286 S. Redman, following an illness of several weeks.

Cora Riggins Boatright, daughter of J. M. and Eliza Riggins, was born May 14, 1864, near Arrow Rock. The family moved to the Herndon community many years ago and there Mrs. Boatright grew to womanhood, and was married November 17, 1887, to the surviving husband. Mr. and Mrs. Boatright went to housekeeping and spent their entire married life at the farm home near Herndon, where they now reside, and where the funeral service will be held tomorrow at 1 o'clock. Burial will be at Ridge Park.

Seven children were born to Mr. and Mrs. Boatright, five of whom survive, Mrs. R. L. Maupin, Malta Bend; Mrs. R. G. Crain, Holliday, Mo.; Mrs. A. J. Dingley, Marshall; Miss Mildred Boatright of the home, and Frank H. Boatright of near Mt. Leonard. Tom Boatright, another son, died about five years ago, and one child died in infancy.

She is survived by seven sisters and brothers, Tom Riggins, Blue Lick; Mrs. Bud Huston, Mountain Home, Ark.; Mrs. T. T. Claycomb and John Riggins, Marshall; Mrs. Ed Zink, Windsor, Mo.; Mrs. Wilma Mallott and Will Riggins of the county. Fifteen grandchildren survive.

Mrs. Boatright was a woman of splendid Christian character. She united with the Methodist church years ago. Her membership was at Hazel Grove, a country church near Herndon, where she gave of her time and means to the support of her Master.

She was devoted to family and home and leaves her husband and children deeply grieved because of her death, as are her many friends who have known her through the years and learned to value her friendship because of her excellent traits of character.

The Weekly Democrat, Marshall, Thursday, August 15, 1912

Louis Boatright - Born and Reared in Saline, Dies at His Home in Suburbs of Marshall At his home in the northwestern suburbs of the city, Louis Boatright, aged 50 years 11 months and 9 days, died Monday, August 12 at 7 p.m. The deceased had been in poor health for a year or more, but kept up and around and his family and friends say often worked beyond his strength, so averse was he to giving up. For several weeks however he had been failing more rapidly and for a day or two the end was expected at any time.

Louis Boatright, who was a splendid Christian gentleman, good citizen and devoted loving husband and father, was born and reared in Saline in the Herndon neighborhood. His aged parents, Wm. G. Boatright and wife still live at the old Boatright homestead, where the deceased was born.

The wife and two daughters, Misses Nell and Ethel Boatright survive the husband and father. Five brothers and four sisters also survive; they are: John, Charles, Finis, Lester, and George Boatright; Mrs. Deal of North Dakota, Mrs. James Finley of Pettis county, Mrs. Tony Maupin of Kansas City and Miss Mary, who is at home with her parents. The deceased and his family moved to Marshall about seven years ago from their country home.

The good influences of his well spent life will live after him in the home and elsewhere, and while the separation brings deep sorrow and grief, the bereaved do not sorrow without hope. They can look beyond the sadness of the present and know that the loved one gone is at rest in the beautiful spirit land, awaiting a happy re-union of his family.

The funeral will take place Wednesday at the M. E. Church South of which Mr. Boatright was a member at 2:30 p.m. Burial at Ridge Park cemetery.

George was raised on that same farm and learned the farming business from his dad, uncles and brothers. George married Laura Belle Golay, the oldest child of David Phillip Golay and Madora D. Hunter, on October 11, 1894. George was 28 years old and Laura was 20 years old at the time of their marriage.

George Boatright Farmhouse - near Houstonia, Missouri

They bought a farm near Houstonia, at the northern edge of Pettis County, Missouri. The back of their farm was on the county line between Pettis and Saline counties. The farm was 160 acres, and George and Laura settled down to life on the farm. Grandson Ned Boatright remembers the story of telephone service coming to the county in the 1910s. The telephone wire was strung by the phone company down highway 65, about a mile away from the farm house. The phone company told George to string a wire from the house to the highway, and they would connect them into the main telephone line, which George and his sons, William and Dean strung.

George and Laura eventually had five children, three of which, William, Dean and Katherine, survived to adulthood. The family rented a house in the town of Sedalia, so that the kids could attend city schools. The house was located at 1316 South Carr Street, Sedalia. During the 1920s, George and Laura struggled to make the farm work financially and were eventually forced to sell it.

Sedalia House - 1316 South Carr George and Laura moved to Kansas City, George taking a job as a City Weigh Master. George passed away on March 10, 1936. Laura lived another 23 years, with daughter Katherine in California.

Notes for EMMA DEAN CARTER:

My grandmother Boatwright, whose name Emma Dean Carter derived from her first marriage, has been a constant source of my early memories. We still are not sure if the “Carter” was her maiden name as my mother told me that my grandmother had a brief first marriage which ended in her husband’s death. Emma Dean went on to bear 13 children only eleven of which survived. My father, Houston Henry Boatwright, was the youngest.

Since she lived with my parents for the years before I was five (and my mother and I moved to California) much of what I know of her history I learned from my mother. My mother said she thought of her as an ignorant uneducated farm wife but from time to time she found glimpses of a beautiful soul who struggled to express her feelings. For instance, she related to my mother how depressed she was when she learned she was pregnant with her 13th child, my father. Another mouth to feed - more laundry - never ending labor. It was the spring of the year 1899, dejected and feeling nauseous with morning sickness she wandered outside, her head hanging low and looking at the ground she observed the first green tendrils of growth starting to push through the tough Oklahoma clay. And all of sudden she felt a tremendous surge of being an integral part of nature. She was growing, too, and producing new life. All of a sudden her spirits soared and she was able to cope with the changes taking place in her body.

Since she was one of my caretakers, I found comfort in her ample lap many times. She was barely five feet tall and about as wide as she was tall. When making bread, she would deliberately lift the dough high over her head and slam it on the counter just to make me giggle and I never remember failing to respond. She was too heavy to bend over and wash her feet, so she would set a pan of water on the floor, place both feet in it and wash one foot with the other. That also, I found very, very funny.

This was during the time of the great depression of the ‘30’s and for spending money she shelled pecans for our neighbors, who had a store in downtown Shawnee. She earned the magnificent sum of five cents a day. I loved pecans and she would let me sample some of what she picked. It never occurred to my childish mind that it meant she earned less money.

She took turns living with her children, which most people in her situation did during that generation, but she came back again and again to my parents since she favored living with them most of all. My mother says her youthful self resented her presence but also knew that without her they could not have survived, since she cared for me while my mother worked as a hotel chambermaid.

My grandmother remembered, as a four year old, sitting on her father’s lap in Alabama, playing with his long beard and his gold watch and then standing at the window watching him march off to the Civil War from which he never returned. My portion of the family is not sure what she and her mother did after that but we do know that when she was living with my parents, she was notified that she was one of the inheritors of the “plantation” in Alabama. Sadly, the statute of limitations had run out and the property had reverted to the State of Alabama. That was a great loss, for any money during the depression would have been a great blessing.

A side note: when my grandmother was not with us and my mother had to work she was allowed to take me with her to the hotel, since the Jewish couple she worked for had a daughter my age and we could play together. My mother related that once in the elevator, when I was with her, a man introduced himself as David Selznik. (Remember, during that time of anti-semiticism Jews could usually only stay at Jewish establishments, even David Selznik). Anyway, he engaged my mother in conversation, asking how old I was. When my mother told him, he said he had a daughter my age and that she should be grateful that I was nearby, because he had to travel so much he hardly ever say his child.

Perhaps one of these days with all the information now available on the internet, we will be able to find out more about Emma Dean Carter, whose middle name I carry.

P.S. My grandmother also had a broken little finger which had not been set properly and it curled in a perfect “O”. I remember her taking a hairpin out of her hair and picking at the center of the “O” in order to clean it.

He married MAHALA ANNE JOHNSON 27 Feb 1875 in Dent County, Missouri, daughter of WILLIAM JOHNSON and ELIZABETH BARTON. She was born 24 Jul 1861 in Reynolds County, Missouri, and died 06 Aug 1934 in Mill Spring, Wayne County, Missouri.

Notes for JAMES "JOHN" M. BOATWRIGHT:

James John M. Boatwright

James spent time in the Missouri State Penitentiary, on a charge of abduction. Court was held in October of 1884 and James reported to prison on November 24, 1884. James was sentenced to two years in prison, but was released on May 22, 1886 after 3/4 of his sentence had been served. The court record indicates that James was born in 1857 in Arkansas and was a silversmith by trade. James' son, Lawrence was born in April of 1885, five months after James reported to prison.

James "John" was murdered in the 1907 at a Fourth of July picnic.

The only thing I know about John's death is that he was at the 4th of July picnic in Mill Spring, Missouri and he was getting ready to play his fiddle with a few other fellow musicians when a man by the name of McAffee walked up to him and said something harsh to which John replied, "You can say what you want about me, but I will not let you speak about my family that way." When John got up, McAffee shot him in the stomach then ran off down the railroad tracks and jumped in the river and no one ever saw him again. That is the story my grandmother told my mother.

While celebrating the 4th of July at Mill Spring that city was the scene of another tragedy, resulting presumably from an old grudge between Charley McAfee and James Boatright.

The two men stepped a few feet away from the dancing platform and passed a word or two, which was unnoticed by the by-standers, when McAfee drew his revolver and fired at Boatright killing him instantly.

McAfee backing off from the crowd with his revolver in his hand, and warning everyone to keep their distance from him, made his escape. He is yet at large.

Chas. McAfee shot and Killed James Boatwright at Mill Spring Picnic

The quietude of the celebration at Mill Spring on our nation's birthday, was broken by a fracas between Charley McAfee and James Boatwright which resulted in the death of the latter.

According to reports the trouble began at the dancing floor Boatwright had McAfee by the collar when a shot from McAfee's revolver ended the life of his antagonist. McAfee stood for a minute, walked backward while facing the crowd till he got behind some buggies then turned and ran away, Sheriff Barrow was summoned to the scene but no arrest has been made.

It was reported to us that Popular Bluff whiskey was the cause of the blood shed but we have learned since that a woman of disreputable character was also connected with the affair.

Trial of Charley McAfee

State v. McAfee: Folder: BOATWRIGHT - Last Modified: 4/27/09 11:24am.

Herbert 8. Hadley, Attorney-General, and F. G. Ferris, Assistant Attorney-General, for the State.

The jury by their verdict found the defendant guilty of murder in the second degree, which was sufficient. If it be held that the jury failed to declare the punishment, then, in such case, it was the statutory duty of the court to assess and declare the punishment and render judgment accordingly. R. S. 1899, sec. 2649; State v. King, 194 Mo. 484; State v. Van Wye, 136 Mo. 243. (2) There was ample evidence to support the verdict of murder in the second degree. The record is free from error, and the judgment should be affirmed.

BURGESS, J.—On the 25th day of January, 1908, the prosecuting attorney of Wayne county filed an information in the circuit court of said county, charging the defendant with murder in the first degree for the killing of one J. M. Boatwright, with a loaded pistol, at said county, on the 4th day of July, 1907. He was tried upon said charge on the 19th day of February, 1908, and convicted of murder in the second degree, the verdict of the jury fixing his punishment "at ten years in the penitentiary." On the same day the defendant filed motions for a new trial and in arrest of judgment, which were overruled by the court. Thereafter, on the 22d day of February, 1908, the defendant and his counsel being present, the court, in view of the informality in the verdict respecting the punishment, changed its terms so as to read "at imprisonment in the penitentiary for the term of ten years." The court thereupon rendered its judgment and passed sentence upon the defendant, from which judgment the defendant appeals.

The testimony discloses that on July 4, 1907, there was a picnic at Mill Springs, Wayne county, Missouri, which was attended by a large crowd of people.

Defendant was early in town that morning, and between nine and ten o'clock in the forenoon he appeared at a store in Mill Springs and traded his watch for a revolver. The deceased, J. M. Boatwright, was seen on the picnic grounds that forenoon, apparently somewhat under the influence of liquor, and was making inquiries for defendant, whom he said he wanted to whip. Boatwright was a short man, weighing about one hundred and sixty-five pounds, and the defendant was about the same weight but taller. About one o'clock in the afternoon, as defendant was leaning against a lemonade stand in the picnic grounds, Boatwright walked up to him and placed his hand on his shoulder. Some words passed between them, and then both men moved out of the crowd and into the open. There is some divergence in the testimony respecting the words which passed between the two men, and the epithets applied by each to the other, while at the lemonade stand and up to the time the fatal shot was fired. According to witness Elmer E. Boggs, who was within ten feet of the parties at the time, he saw both come out of the crowd, each man with his hand on the other's shoulder, and heard Boatwright say to defendant that he would "go out of the crowd with him or any other son-of-a-bitch." The defendant said, "Do I understand you to call me a son-of-a-bitch?" Boatwright made no answer, but told defendant to take his hand out of his hip pocket and he would fight him fair. He then proceeded to take off his vest, and while in the act of doing so he was shot by the defendant with a pistol which he drew out of his right hip pocket. After the shot was fired Boatwright fell forward and grabbed at the pistol, and then fell on his back and died. This witness also testified that neither man appeared excited, but cool and self-possessed, and that at the time the fatal shot was fired they were two or three feet apart.

Judge Creecy testified that he was within ten or fifteen feet of the men when the trouble commenced. He saw Boatwright motion to defendant and heard him say.'' Come out of the crowd, you damn-son-of-a-bitch; I can whip you." Defendant seemed angry, but not excited, and said, "Don't call me that any more." Boatwright then said, "I'll call you anything I want to." The defendant put his hand into his hip pocket, and Boatwright commenced pulling off his vest, saying, "I'll whip you any way, with your hand in there," and applied another ugly epithet to the defendant. Immediately the defendant fired, and Boatwright said, "You have killed me," whereat the defendant said, "If I ain't, Gf—d d—n you, I can do it." As soon as Boatwright was down, the defendant drew his pistol on him again with both, hands, at which time witness Creecy stepped up to the defendant, and said, "Don't shoot him any more. You have already killed him; look at the blood on his shirt." To this defendant replied, "You stand back and keep your hands off of him or I will put one in you." Several other witnesses for the State testified much to the same effect, the testimony differing somewhat as to the details, all agreeing, however, that Boatwright was in the act of taking off his vest when the defendant shot him. There was no evidence that deceased struck at the defendant or that he had any weapon. Dr. Owens, who was also an eye-witness to the shooting, and whose testimony was like to that of the other witnesses for the State, examined the body of the deceased, and found a bullet wound in his right breast, between the first and second ribs. He testified that this wound caused the death of the deceased.

Charles McAfee, the defendant, testifying in his own behalf, said that a week before the said Fourth of July, Sarah Baker told him that Boatwright was going to kill him on sight. He had seen Boatwright twice in the morning, but avoided him, and was told that morning, at the picnic, by Sarah Baker, Alice Swann and George Mann that Boatwright was hunting for him. He said he was standing at the lemonade stand talking with Mr. Mann, who had just told him that Boatwright was hunting him, when Boatwright approached, grabbed him by the left arm, called him a vile name, and then said: "Come out here; I am going to kill you." To this the defendant replied, "No, sir; I don't think any of the Boatwrights can do that." He testified that Boatwright held to his arm and pulled him out of the crowd, he resisting all the time, and that as Boatwright made a movement with his hand towards the right-hand pocket of his pants he (defendant) shot him. He said that he was not able to meet Boatwright in a physical encounter, and was not his equal in size or strength. He denied that the deceased was taking his vest off when he shot him, or that deceased told him to take his hand out of his pocket, or that he said he would fight him fair. In defendant's behalf, Sarah Baker testified that about a week before said day she heard Boatwright threaten defendant's life, and that about 9 o'clock on the morning of that day Boatwright told her he was hunting defendant and that he was going to kill him, which threats she communicated to defendant that morning. She stated that she witnessed the beginning of the difficulty ; that she was on one side of the lemonade stand, and the defendant and Boatwright on the other; that Boatwright went up to the defendant, grabbed him roughly by his shoulder, addressed him in insulting language, and said that he was going to kill him. Her testimony further disclosed that there was ill-feeling between the defendant and Boatwright's half-brother, Ed Boatwright, resulting from their respective attentions to a Mrs. Swann.

Kufus Tindall, in defendant's behalf, testified that in the morning of that day he met Boatwright, who inquired for the defendant, 'saying that he was going to give him a good whipping; that about one o'clock he again met Boatwright, who inquired if he had seen the defendant, and that as he made the inquiry he saw the defendant, and remarked, "What I am going to do to him will be a plenty." Tindall requested him not to get up any trouble, and Boatwright, who had a knife in his hand, whittling, at the time, said, "I just want to get to stick that much of the blade in his heart." Witness further said that Boatwright seemed mad; that he went up to the defendant, took him by the shoulder and told him that he was going to give him a whipping; that he pulled the defendant along, the latter resisting, until they emerged from the crowd, when Boatwright stepped in front of defendant, and they both stopped; that defendant drew his pistol, and Boatwright seemed to be grabbing at it, defendant fired, and Boatwright pitched forward against him.

Ben Nation, witness for the defendant, testified that Boatwright .took hold of defendant's shoulder, pulled him along, and said that he was going to give him a good whipping; that Boatwright was grabbing at defendant's pistol as the shot was fired, and that Boatwright's vest was on one shoulder only when he fell.

Defendant introduced four witnesses who testified that Boatwright's reputation in the community was that of a quarrelsome, turbulent and dangerous man.

While the defendant is not represented in this court, we have carefully gone through the record, and find it free from substantial error. Under the evidence, the defendant might well have been convicted of murder in the first degree. While he did not seek the quarrel with the deceased, he provided himself with a pistol in anticipation of it, and took advantage thereof to shoot the deceased, who was unarmed, and who at the time the shot was fired was in the act of taking off his vest. The deceased had not struck at the defendant, but was at the time merely preparing for a personal encounter with the defendant, whom he had threatened to whip. It is true, the deceased had applied insulting epithets to the defendant, and threatened to whip him, but there is no evidence tending to prove that the defendant was thereby aroused to a sudden heat of passion, the testimony, on the contrary, being that both men appeared to be cool and self-possessed at the time. Even after the shot was fired, and the deceased had fallen, the defendant was about to shoot again when one of the witnesses present interfered and told him to desist. Indeed, from all the evidence, it is plain that the killing was done with premeditation and deliberation, and the defendant might well count himself fortunate in escaping -with so light a sentence.

The judgment is affirmed. All concur.
